A: The HOA will send up to three violation notices over a 45-day period of time to the homeowner. If there is no response from the homeowner and no correction of the violation, the HOA request permission from the Board of Directors to turn the matter over to the HOA attorney.
Q: If a home is in foreclosure, who is responsible to take care of the property?
A: If the bank and/or mortgage company has taken title to the property, they are the legal owner and are responsible to maintain the property. The HOA will send violation notices to the mortgage holder. Due to the large number of foreclosures, the mortgage holders are not responding to request to maintain properties.
Q: What is being done about the vandalism in and around the Amenity Center as well as in the community?
A: The HOA has hired off duty Lake County Sheriff officers to patrol the common grounds and the community regularly throughout the week and week ends. They have the power to arrest anyone caught committing a crime. The HOA will prosecute anyone found guilty of committing a crime to the fullest extent of the law. In addition a community Neighborhood Watch program has been implemented within the community.
Q: What is the rule on commercial vehicles parking in the community?
A: Commercial vehicles (vehicles with lettering visible on them, utility trailers, vehicles with ladder racks, commercially licensed vehicles, and any other marking or feature that would indicate that it is a commercial vehicle) are not permitted to park on the streets or driveways. They can be stored in the garage or if the vehicle is less than ¾ ton and a magnetic sign(s) can be applied to hide all lettering, they may be considered acceptable. Police vehicles are exempted. Temporary loading and unloading for service vehicles is permitted.

A: The landowner for the lots in Phase IV is EMF Capital. They are aggressively pursuing acquiring a new builder and have told the HOA that they may have an announcement on a builder before the end of the year.

A: Yes, EMF Capital is paying assessments on all of the vacant lots in Phase IV.

A: Not in all cases. However, as soon as a homeowner stops paying their assessment for any reason a lien is automatically placed on their home. Florida law provides that the lien stays with the land and therefore when the home is sold to a new owner, the past due assessments, late fees, interest, and legal fees must be paid to the HOA before closing.

A: Any changes to the exterior of the home must first be approved by the Architectural Review Board (ARB). The ARB has 30 days to review any application submitted.

A: The tracts of land that surround the golf course can generally be broken down into two scenarios. Land that looks like sand traps and drainage areas is the responsibility of the Country Greens Community Development District (CDD) and the green turf areas is the responsibility of the Eagle Dunes Golf Course. Areas behind the homes on S.R. 437 are the responsibility of the CDD.
